Terms of Use

These Terms of Use ("Terms") govern your access to and use of https://olidays.in and related services. By accessing or using the Platform, you agree to these Terms and our Privacy Policy.

OLIDAY (MRAKL BASICS PVT LTD) operates an online platform connecting Guests with independent property partners (hotels, resorts, homestays). OLIDAY facilitates listings, search, booking workflow, payment facilitation (as applicable) and customer support. Properties are independent service providers; OLIDAY is not the accommodation provider unless explicitly stated.

You must be 18 years or older and legally capable of entering into contracts to use the Platform.

You must provide accurate information when registering and keep account credentials secure. You are responsible for all activity under your account.

Booking Process

Bookings made on the Platform are subject to availability. The booking confirmation email and booking page display the applicable cancellation policy, price, taxes, and who collects payment (OLIDAY or the Property).

Payment Collection & Holder

• Payments may be collected and held either by OLIDAY (or our payment processor) or directly by the Property as indicated during booking.
• Where the Property collects and holds payment, OLIDAY acts as a facilitator and record-keeper; the Property is responsible for refund execution unless otherwise agreed.
• Where OLIDAY or its payment processor collects payment, OLIDAY will initiate refunds per the applicable policy and payment processor rules.

Payments & Payouts

Commission, payout timelines, and guest advance rules are specified in Property commercial terms and displayed in partner agreements and Schedule A. Typical commercial terms: commission 10–20% (example), guest advance 30–100% (example), payouts 24–48 hours after stay/checkout (excluding bank holidays), subject to individual partner settings and settlement cycles.

Taxes & Invoicing

Prices will indicate tax treatment at checkout. Properties must provide valid invoices and GST documents to Guests and OLIDAY as required.

Cancellation terms applicable to a booking are displayed at checkout and in the booking confirmation. OLIDAY's default cancellation policy applies unless a property-specific policy is displayed and accepted at booking.

Property Responsibilities

Properties must maintain accurate listings, honor bookings, provide services at advertised standards, comply with local laws (registration, licences, safety, fire norms, GST), and maintain appropriate insurance.

Guest Responsibilities

Guests must provide accurate information, follow property rules, present valid ID at check-in where required, and respect property policies.

Users may post reviews and ratings. OLIDAY may moderate content to remove unlawful, offensive or fraudulent content. By posting content you grant OLIDAY a license to use it for promotional and operational purposes.

The Platform content is owned or licensed by OLIDAY. You may not reproduce or use it without prior permission.

Disclaimer

Services are provided "as is". OLIDAY disclaims implied warranties to the maximum extent permitted by law.

Limitation

OLIDAY's aggregate liability for any cause of action related to a booking is limited to the amount paid by the Guest for that booking. OLIDAY is not responsible for property-level issues (service quality, safety, theft, injury), except to the extent caused by OLIDAY's gross negligence or willful misconduct.

You agree to indemnify and hold OLIDAY harmless from claims arising from your use of the Platform, breach of these Terms, or violation of law.

These Terms are governed by the laws of India. Disputes shall be referred to arbitration in Gurugram (or other mutually agreed venue) under the Arbitration and Conciliation Act, 1996, except where local law mandates another forum.

OLIDAY may suspend or terminate user accounts for policy violations or misuse. Users may close their account per account settings; certain data may be retained as required by law.

OLIDAY may amend Terms; material changes will be notified. Continued use after notice constitutes acceptance.
